WD-40® “ULTIMATE OUTDOORS” CONTEST 1. HOW TO ENTER: No Purchase Necessary. WD-40 Ultimate Outdoors Contest (the “Promotion”) begins on or about August 22, 2007 at 9:00 a.m. ET and ends on July 31, 2008 at 5:00 p.m. ET. There are two ways to enter: A. Enter on-line: Sweepstakes: Access www.ultimateWD40.com or www.concoursreveWD40.com (the “Contest Website”) between 9:00 a.m. ET on August 22, 2007 and 5:00 p.m. ET on July 31, 2008 (“Promotional Period”) for entry into both the Instant Win Contest and the Sweepstakes. To enter the Sweepstakes, complete the on-line entry form, enter one valid unused Entry Code number (“Entry Code”) located on specially marked WD-40 311g and 325g Smart Straw™ cans, and submit as instructed. All fields on the entry form must be completed unless they are indicated as optional. Instant Win Contest: After entering the Sweepstakes, you will automatically be eligible to be a selected entrant. An Instant Win message may (or may not) then appear on the Contest Website stating the prize. If such a message appears, you are eligible to win. Follow the prize claim instructions in Rule 2 below. Limit one (1) on-line entry per person, per Entry Code. In case of dispute as to the identity of the person who submitted an on-line entry, entry will be deemed submitted by the natural person who is the registered user of the email account. Any use of robotic, automatic, programmed or like entry methods will void all entries affected by such methods and be deemed as tampering. Each on-line entrant has the option to use the “Email-A-Friend” form on the Contest Website to receive one (1) additional entry into the Sweepstakes. General Conditions of Entry: Once submitted, entries become the exclusive property of WD-40 Products [Canada] Ltd. (the “Sponsor”) and will not be returned. Personally identifiable information received will be used only to verify eligibility and award prizes. This Promotion is subject to all applicable Federal, Provincial and Municipal laws, and is void where prohibited. 2. SWEEPSTAKES PRIZES: There are five (5) Grand Prizes available to be awarded. Grand Prizes include the following: • One (1) ’07 or newer Kawasaki Jetski Ultra 250X. The Ultra 250X personal watercraft features: 3 rider capacity, 1,498cc four stroke in-line four, supercharged engine, fuel injected and a water inducted cooling system. Current approximate retail value of $10,899 CDN; • One (1) ’08 Kawasaki TERYX 750 4X4. Current approximate retail value of $13,499.00 CDN. The Sponsor reserves the right to substitute any prize with a prize of equal or greater value. All Grand Prizes have no cash value and must be accepted as awarded. All other costs and expenses incurred by the winner in claiming or using the prize including license, registration, insurance, accessories, and any other vehicular or transportational requirements are the sole responsibility of the winner. 3. INSTANT WIN PRIZES: There are two thousand and five (2,005) on-line Instant Win prizes available to be won at the beginning of the Promotional Period. Instant Win prizes include the following: • Two thousand (2,000) WD-40 7.7mL “No-Mess Pen“ valued at approximately $3.99 each; • One (1) ’07 or newer Kawasaki Motorcross KX 85. The KX 85 competition styled motocross machine features: a 2-stroke, 84cc single cylinder engine. Current approximate retail value of $4,349.00 CDN; • One (1) ’07 or newer Kawasaki Off-road KLX 110. The KLX 110 "off-road" model features: a 4-stroke, 111cc single cylinder engine with a 3-speed automatic clutch transmission. Current approximate retail value of $2,599.00 CDN; • One (1) ’07 or newer Kawasaki ATV KFX 50. The KFX50 features: an environmentally friendly 4-stroke, 49cc single cylinder engine including an electric starter. Current approximate retail value of $2,449.00 CDN; • One (1) ’07 or newer Kawasaki Jetski SX-R 800. Current approximate retail value of $9,299.00 CDN; • One (1) ’07 or newer Kawasaki Motorcross KX 65. The KX 65 competition style motocross machine features: a liquid cooled, 64cc 2-stroke, single cylinder engine. Current approximate retail value of $3,749.00 CDN. The Sponsor reserves the right to substitute any prize with a prize of equal or greater value. All Kawasaki Instant Win Prizes have no cash value and must be accepted as awarded. The number of Instant Win prizes available to be won will diminish as prizes are awarded during the Promotional Period. All Entrants who submit an Entry Code at the random dates and times selected prior to the start of the Promotion Period, will be eligible to win. Odds of receiving an Instant Win message will depend on the date and time an entrant submits the Entry Code. If no entrant submits an Entry Code at the predetermined time, the next entrant to submit an Entry Code immediately following that predetermined time will be eligible to win. In the event of a dispute concerning what time an entry was submitted, the computer logs of the Contest Website will govern. Limit one Instant Win message per person. All Instant Win prize claimants for the “No-Mess Pen” must correctly answer the on-line skill-testing questions and confirm compliance with the Rules and Regulations. All prize claimants for the Kawasaki Instant Win prizes must complete a Declaration and Release form, answer a skill-testing question, and confirm compliance with the Rules and Regulations. Only after correctly answering the skill-testing question, confirming compliance with the Rules & Regulations, and if applicable, complete a Declaration and Release form (as described below in Rules 5), will the recipient of an Instant Win message be declared an official winner. If a person under the age of majority in his/her province/territory of residence (a “minor”) is eligible to win, a parent or legal guardian must accept the prize on their behalf. Please allow 6-8 weeks for delivery of the “No Mess-Pen”. See Rule 10 for delivery details on Kawasaki Grand and Instant Win prizes. All other costs and expenses incurred by the winner in claiming or using a Kawasaki Instant Win Prizes including license, registration, insurance, accessories, and any other vehicular or transportational requirements are the sole responsibility of the winner. 4. SWEEPSTAKES RANDOM DRAWING: Grand Prize: A random draw administered by the Independent Sweepstakes Judging Organization will take place August 14, 2008 at approximately 10:00 am ET in Uxbridge, Ontario from all entries received to select the five (5) Grand Prize winners. Odds of being selected are dependent on the number of eligible entries received. The selected entrants will be contacted by telephone or e-mail. Only the selected entrants will be notified. In order to win, the selected entrants must correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question. If an eligible entrant cannot be reached within ten (10) business days of the draw, the selected entry will be deemed void and an alternate entrant may be selected. Only upon signing and returning the Declaration and Release Form described below in Rule 5 and correctly answering the skill-testing question, will a selected entrant be declared an official winner. If a minor is eligible to win a prize, a parent or legal guardian must complete the Declaration and Release Form and accept the prize. For all reasons including tax, that parent or guardian is deemed to be the winner of the Sweepstakes Prize. 5. RELEASE FORMS: All selected entrants for the Kawasaki Instant Win and Sweepstakes prizes will be required to sign and return, within the time stipulated in the documents, a Declaration and Release Form. All selected entrants for the No-Mess Pen Instant Win Prizes will be required to confirm compliance with the contest Rules and Regulations and answer a mathematical skill-testing question. Release Forms will release the Sponsor, Canadian Kawasaki Motors Inc. (“Kawasaki”) (Promotional Partner), retail partners, its affiliates, subsidiaries, related companies, dealers, and all their respective directors, officers, employees, shareholders, representatives and agents, successors and assigns from and against any and all liability, claims of damages and causes of action, of any kind whatsoever, whether at law or in equity, and including but not limited to death, personal injury and loss or damage to property, that the winner or any of their representatives, heirs, next of kin or assignees (collectively, “Representatives”) may have or which may hereinafter accrue to the winner’s Representatives as a result directly or indirectly from their use or acceptance of the prize, or the contest. In the Declaration and Release Form, winner will also confirm compliance with the Rules and Regulations and consent to the use of their name, place of residence and photograph, without further compensation or notice, in any publicity carried out by the Sponsor, Promotional Partner and/or their advertising and promotional agencies. Failure to return the forms within the time specified in the documents may result in the forfeiture of the prize. In the event of non-compliance with these requirements (as applicable) or if prize notification is returned undeliverable, prize may be forfeited, and an alternate winner selected. 6. ELIGIBILITY: This Promotion is open to legal residents of Canada that are 13 years of age and older, except employees of: the Sponsor, their Promotional Partner, its affiliates and related companies, its advertising and promotional agencies, the Sweepstakes Judging Organization and members of the immediate family and household of such employees. In these rules, “immediate family” means mother, father, daughters, sons, sisters, brothers, and spouse, regardless of where they live. 7. LIMITATIONS OF LIABILITY: Sponsor will not be liable for: a) any incomplete or inaccurate capture of information, whether caused by Contest Website users or by any equipment or programming associated with or utilized in the Promotion, or by any technical or human error which may occur in the processing of entries; b) the theft, destruction or unauthorized access to, or alteration of, entries; c) any problems with, or technical malfunctions of, telephone networks or lines, computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; d) any failure of any email to be received by or from Sponsor for any reason including but not limited to traffic congestion on the Internet or at any website or combination thereof, interrupted or unavailable networks; e) damage to a participant’s or other person’s system occasioned by participation or downloading of materials in this Promotion; f) late, delayed, damaged, misdirected, destroyed, lost, illegible, incomplete, incorrect, stolen, postage-due or wrongly addressed entries which will be void. 8. RIGHT TO TERMINATE, ETC.: Subject to obtaining the approval of the Régie des alcools, des courses et des jeux (the “Régie”) with respect to the province of Quebec, the Sponsor reserves the right, at its sole discretion, to terminate, suspend or modify this Promotion, without notice, at any time should fraud, virus, bugs, or any other cause beyond the control of the Sponsor corrupt the administration, security or proper conduct of any element of this Promotion as described in these Official Rules. 9. ERRORS, ETC.: Any Grand Prize or Instant Win Messages, or any other materials used in this Promotion which have been tampered with, mutilated, altered, forged, reproduced, not legitimately obtained, are illegible or which contain or reflect printing, production or other errors will be void. Sponsor reserves the right to amend or terminate this Promotion at any time without prior notice (except to the Régie) if any factor interferes with its proper conduct as contemplated by these Official Rules. Without limiting the generality of the foregoing, Sponsor reserves the right to terminate this Promotion subject to the approval of the Régie, should any error, whether human, electronic, or otherwise, or any other event or error result in more than the stated number of prizes of any category being claimed. In such event, the prizes not yet awarded may be awarded in a random drawing amongst all eligible claimants who have not yet received a prize. In any such drawing, the selected entrant must correctly answer a mathematical skill-testing question without assistance of any kind whether mechanical or otherwise and execute any documents as may be required before being declared a winner. 10. MISCELLANEOUS: By entering, entrants agree to abide by the Official Rules and agree that the decisions of the Sponsor and Sweepstakes Judging Organization are final and binding in all matters relating to this Promotion. The prizes must be accepted as awarded and no transfer or substitution of the prize, whether for cash or otherwise, will be permitted except as expressly provided in these Rules or at the Sponsor’s sole discretion. Prizes may not be exactly as shown on Promotion publicity or promotional materials. The Sponsor reserves the right to substitute this prize with a prize of equal or greater value if for any reason the prize cannot be awarded as contemplated in these Rules. The winner of the Grand Prizes and Kawasaki Instant Win Prizes will be required to pick-up their prizes at the closest authorized Canadian Kawasaki dealer. Please allow 8-10 weeks for delivery. Vehicles must be picked up within 4 weeks of vehicle availability. The Sponsor reserves the right to change the date for reasons that are reasonably beyond its control. Sponsor reserves the right at its sole discretion to disqualify, from this Promotion and any future contest, sweepstakes or other promotion conducted by Sponsor, any individual that it finds or believes to be tampering with the entry process or the operation of the Contest or Contest Website; to be acting in violation of the Official Rules. 11. QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity sweepstakes may be submitted to the Régie des alcools, des courses et des jeux for a ruling.
